Rental Agreement and Liability Declaration
DutchFellas, E-bike Rental, Malaga

This rental agreement forms one whole together with the DutchFellas General Rental Terms and the Damage and Replacement Charges.

1. Renter details

The renter details, including name, phone number, email address, nationality, identity number and stay address, are recorded with the booking and form part of this agreement. Identity may be checked against an original identity document at handover.

2. Rental details

Booking reference, pickup date and time, return date and time, total rental price, payment method, delivery or pickup and the deposit status are recorded with the booking and form part of this agreement.

3. Bikes and accessories

For each bike the model and the Bike ID are recorded, together with the visible condition at handover. Accessories issued may include a helmet, lock, charger, phone holder, child seat, bag or thermobox and other items. Before departure the brakes, the electric assistance and the lock procedure are explained, and it is established that the bike or bikes are handed over in visibly good condition.

4. Important financial responsibility

The renter is responsible for the bike or bikes and all supplied materials during the rental period. In the event of loss, theft, damage through incorrect use or missing parts, costs may be charged in accordance with the DutchFellas General Rental Terms and the Damage and Replacement Charges.

Main amounts as an indication. Fatbike or e-bike: whole bike up to 2,700 euro, battery up to 750 euro, motor up to 800 euro, key up to 100 euro. Cargo bike: whole bike up to 4,300 euro, battery up to 850 euro, motor up to 1,200 euro, key up to 150 euro. Late return and traffic fines are always for the account of the renter.

5. Declaration and signature at handover

I declare that I have received the bike or bikes and accessories in usable and visibly good condition, that the use and the lock have been explained to me, and that I use the bike or bikes at my own risk.

I am responsible for safe use, for compliance with traffic rules, for damage I cause to myself or to third parties, and for the bike or bikes and accessories during the rental period.

I declare that I have received the DutchFellas General Rental Terms, that I have been able to take note of them, and that I accept them as an integral part of this agreement.

6. Return inspection

On return it is checked whether the bike or bikes were returned on time, whether the supplied accessories are complete, whether new damage or defects are visible, whether the bike or bikes were used cleanly and normally, and whether any additional costs apply.

Any costs are specified on the basis of reasonable repair costs or the applicable damage and replacement charges from the general rental terms. In the event of theft, immediate notification to DutchFellas and a police report are mandatory.

General Rental Terms
DutchFellas, e-bikes, fatbikes and cargo bikes, Malaga

These terms form one whole together with the rental agreement.

1. General
DutchFellas offers electric bike rental in Malaga.
By making a reservation or renting a bike, the renter agrees to these general rental terms.
These terms apply to online bookings, on-site reservations and direct rental in the shop.

2. Reservation and payment
Reservations can be made online or on site.
Payment can be made by Stripe, card, cash or another method accepted by DutchFellas.
DutchFellas may require full prepayment for online bookings. All prices include applicable taxes unless expressly stated otherwise.

3. Cancellation and refunds
Free cancellation is possible up to 24 hours before the start of the rental period, unless agreed otherwise in writing.
No refund is given for a no-show, late arrival or early return of the bike, unless DutchFellas decides otherwise at its own initiative.

4. Responsibility during the rental
During the rental period the renter is responsible for the bike and all supplied materials, including in any case the battery, keys, locks and accessories.
The bike must be returned on time and in the same condition in which it was received, except for normal and reasonable signs of use.

5. No deposit and financial liability
In principle DutchFellas does not apply a standard deposit. This does not mean the renter is released from financial responsibility.
The renter remains fully liable for loss, theft, missing parts and damage arising during the rental period or through improper use.

6. Damage, loss and replacement costs
The amounts included in the appendix apply as guide amounts or maximum replacement costs per component and per incident.
Where repair is possible at demonstrably lower cost, the reasonable actual repair costs may be charged.
Where the actual damage is demonstrably higher due to serious damage, missing parts or demonstrably incorrect use, DutchFellas reserves the right to pass on the actual damage insofar as this is reasonable and substantiated.
In the event of theft or loss, immediate notification to DutchFellas and a police report are mandatory. Without a police report the renter remains fully liable.

7. Correct use of the bike
The renter uses the bike carefully and for its normal purpose.
It is not permitted to ride the bike over the beach, through sea or water, in deep gravel or mud, or on stairs.
Racing, stunts, renting or lending to third parties, and use under the influence of alcohol or drugs are not permitted.
Damage caused by incorrect or reckless use is entirely for the account of the renter.

8. Safety and traffic rules
The renter must comply with all applicable traffic rules and instructions.
The renter is responsible for safe riding behaviour and for damage he or she causes to third parties.
DutchFellas is not responsible for the loss of personal property taken along or left behind by the renter.
Nothing in these terms limits the statutory liability of DutchFellas for damage that may not be excluded under mandatory law.

9. Late return
In the event of a late return, DutchFellas may charge additional rental costs based on the applicable rental period, day rate or reasonable additional operational costs.
Where a late return causes a following reservation to be missed, DutchFellas may also pass on the reasonable damage resulting from that.

10. Delivery and pickup
Delivery may be available within a selected area. Any delivery costs are communicated in advance.
The customer must provide a correct address and be present at the agreed time. Additional costs caused by incorrect or incomplete details may be passed on.

11. Breakdown assistance
In the event of technical problems, DutchFellas will, where reasonably possible, provide assistance or offer a replacement bike.

12. Identification and privacy
At the start of the rental a valid identity document may be requested in order to verify the identity of the renter.
DutchFellas only records the data reasonably required for rental, administration, damage handling, fraud prevention and customer service.
A bike may be fitted with a GPS tracker for security, theft prevention, recovery of company property and operational management. By renting, the renter acknowledges that this processing may take place for those purposes.

13. Traffic fines and seizure
Traffic fines, police or government costs and costs arising from the seizure of a bike as a result of the renter actions are entirely for the account of the renter.

14. Minors
Rental to minors is only permitted if DutchFellas expressly agrees to it and a parent or legal representative co-signs.
In that case the parent or legal representative is jointly and severally responsible for compliance with this agreement and for the costs arising from it.

15. Final provision
By signing the rental agreement the renter confirms having received, read and accepted these terms.
If any provision of these terms is invalid or unenforceable, the remaining provisions remain in full force.

Explanation
The amounts below apply per component and per incident as a guide amount or maximum replacement cost. Where demonstrable repair costs are lower, DutchFellas may charge the lower reasonable repair costs. All amounts are in euro. Where several components are damaged or missing, the amounts may be applied cumulatively insofar as this is reasonable and substantiated.
